Scope of Services

The role of the ICD is to:

  1. draft and negotiate multilateral treaties relating to organizations  such as the United Nations (UN), African Union (AU), World trade organization (WTO), Southern African Development Community (SADC) as well as the Southern African Customs Union(SACU) on behalf of the Government;
  2. draft and negotiate bilateral agreements on behalf of the Government such as Boundary Treaties, One Stop Border Post and Joint Permanent Cooperation Agreements;
  3. provide legal advice to the Government of the Republic of Botswana on regional economic integration, Free Trade Area Agreements, trade negotiations, the international sale of goods, Bilateral Investment Treaties and various bilateral agreements involving individual Member States;
  4. advise on the signing, accession to, ratification and implementation of treaties, and international agreements;
  5. provide legal advice to the Government on various specialised areas such as Intellectual Property Rights, Competition Law, Company Law, Privatisation, Public Private Partnerships (PPP’s), Procurement issues, Project Management;
  6. provide Government with legal advice on environmental issues, matters involving    international boundaries, international rivers and water rights; and
  7. draft and negotiate commercial agreements on behalf of the Government of Botswana.
